Fayetteville, 1993: Convincing Planning Commission to do the right thing took a form of video guerilla warfare

This is sort of an instructive lesson in why every community needs public access television.
When the Fayetteville Government Channel First came into being in 1992, most of the volunteer committees set up by the city agreed to have their meetings shown on TV, except for the Planning Commission. Long considered to be one of the most important government bodies, their decision seemed unfathomable. And yet they were unapproachable on the subject
Some folks would have gone, “Ah well, maybe they will see the light one day,” but then again, that would have been stupid. A group of us determined to tape their meetings and put them on public access until the Planning Commission agreed to allow FGC cameras to tape them.
The entire process took several months. It needs to be noted for the “Tsk, tsk” crowd that, unlike the pasty-faced little thugs who did the job on ACORN some time back, we presented the commission meetings in their entirety - even when we were having fun editing.
Hell, no, we won't go - on Television

Many communities across the United States enjoy a form of television known as a PEG system - channels provided by the city, for the benefit of the local citizens. PEG (Public, Education and Government) channels are very popular across the country. Not only do they offer locals the chance to speak out on a wide variety of topics, but the government channels also serve as a local form of C-Span, offering gavel-to-gavel coverage of city/county meetings.
It provides a window into the process of government usually not afforded to those unable to physically attend meetings. As a result, such channels are at once very popular with local citizens, and a little unnerving to elected officials - especially in towns who don't offer these channels, but whose citizens would like them.
There is nothing like a little empowerment to make some elected officials nervous.
In Fayetteville, before 1992, everything was offered on just one public access channel, Fayetteville Open Channel. Because of time constraints, only the meetings of the Fayetteville City Council and the Washington County Quorum Court were aired on FOC.
In 1992, things changed radically, when the city of Fayetteville officially offered three separate PEG channels. It was hardly a seamless operation, though. From the very beginning, some were determined to be dragged kicking and screaming into the age of television - if at all.
It took several months for the new Fayetteville Government Channel to set things up so that they could tape as many meetings as they needed to. Then, as now, much depended upon both time and the availability of personnel.
Nevertheless, the new channel was very popular with the citizens of Fayetteville. For the first time, not just city council or county meetings were shown, but also committee and commission meetings, made up of citizen volunteers.
Fayetteville itself has long had a reputation for being one of the most politically diverse - and divisive - cities in Northwest Arkansas. The home of the University of Arkansas, Fayetteville has been known for many years as "The Athens of the Ozarks" - a place not only known for its beauty, but also for the spirited and intelligent debate that often marked public controversies.
In fact, public access television itself had almost been lost due to bitter public debates in the community. But by 1992, all of this was behind Fayetteville; not only was there a new access provider, but a new government channel that everyone was pleased about.
Well, not quite everyone.
The entire subject of having cameras in public meetings was a sore point with some in the business community. In fact, during a public survey (The Fayetteville Vision Project), several in the Chamber of Commerce had felt that cameras should be removed from City Hall entirely.
The chief problem with "empowerment" is that all too often the "wrong" sort of people are empowered. And for several years, activists of all stripes had utilized public access well in Fayetteville. Not only that, but folks were not too shy about expressing themselves at council meetings.
Take the cameras away, some felt, and the activists would melt away into the woodwork.
Though those who would remove cameras altogether failed to make any headway, there was still another way to thwart those activists - or "aginners" as one daily newspaper referred to them, meaning that they were against progress for their community.
Though most committees and volunteer boards at City Hall, had no problem with going on Fayetteville Government Channel, there were a few holdouts - chief among them being the Planning Commission.
Though each and every city board and commission (made up of unpaid citizens who volunteer their time and energy) is important, some deal with issues that can directly affect every man and woman among us, and the Planning Commission is one of those.
One of the commission's jobs is to see that Fayetteville, which is growing by leaps and bounds, has some control over that growth. A city that doesn't endeavor to plan for the future may well find itself turning into an urban nightmare.
Naturally, the workings of such a body will attract a lot of public attention, some of it unwanted. To the consternation of much of the viewing public of Fayetteville, in July of 1993, the Planning Commission voted formally not to allow FGC to videotape and show their meetings.
That should have been the end of it. Nothing to see here, folks. Everybody move along, now.
Some might have whined. Some might have said, "oh, well, you can't have everything." But if you're gonna live in a town known as the Athens of the Ozarks, you gotta earn the right to call yourself that.
The Planning Commission hadn't factored public access television into their calculations.
October: it must have surprised the Planning Commission to see volunteer public access producers come into the city council chambers (where the commission held their meetings) and set up field cameras.
Full Disclosure Time: I was part of that crew.
Though cameras were in operation, no one seemed to be playing to them, even though some in the audience obviously cared very much about the subjects they spoke about, namely their neighborhoods.
The meeting went by without a hitch. Although we didn't use the city cameras that were in place for meetings, the meeting - which aired on Fayetteville's public access station - looked as good as any seen on the FGC.
Through back channels, however, we learned that there were some on the Planning Commission who were very annoyed that the cameras were there, though there was nothing they about do about it.
There were other issues at stake, other than simply having important meetings shown to the public. Several of the members of the commission had uncomfortably close business ties - not only with each other, but with developers coming before the commission.
The situation went on for several months. Public access producers taking time out of their lives to tape and edit a government meeting, because the body in question still refused to allow "official" cameras into their meetings. There didn't seem to be much logic involved.
Looking back, I can only assume that they thought we'd get tired of it after a while, and leave them alone.
In fact, just the opposite happened. While the Government Channel, like the aforementioned C-Span, offers gavel-to-gavel coverage of meetings, there was a distinct advantage independent public access producers had over government employees. Though we had taken pains to make our tapes look as professional as possible, we realized we weren't bound by that.
The Planning Commission was going to tired of us long before we got tired of them.
We started small, with just a few innovations. "NYPD Blue" was still in its infancy, and handheld camera shots were all the rage. Accordingly, while one of our cameras remained on a tripod, one of our camera people would hoist a camera over his shoulder and walk around the room, getting angles that were creative, to say the least.
Then, in the editing room, some parts of the meeting might end up being in black and white. Film noir, anyone?
And for those who liked foreign films - ala Godzilla - some sequences might find a commission member opening their mouth to speak, and their voice catching up with them a few seconds later.
Still, no luck. Though we were having great fun at the commission's expense, they weren't budging. Though we were all adults, we were tolerated as though we were a neighbor's particularly backward children. So, we upped the ante, just a little.
We already knew of the close business ties that at least two members had with each other, and with those who came before the Planning Commission. On-screen, when they would appear, their business connections would be linked via graphics.
That went on for a few meetings, and then the ultimate touch was added. As Gilbert and Sullivan played over the end credits, all of the members' financial ties were listed, along with information as to which business interests had donated money to their various failed political campaigns.
Applause followed at the end of the program.
That seemed to do the trick. We were officially "invited" to a Planning Commission meeting, where not a word was said about the content of the meetings that had been shown on public access television. Instead, those of us who stood up spoke about the First Amendment, the People's right to Know, and I even talked about how much better the meetings would look, using the Government Channel equipment.
With no discussion, they voted to allow their meetings to be shown on FGC.
Life went on. We all went back to our own projects, the Planning Commission was on television on a regular basis, and the citizens at home learned more about their city government.
That's as close to a happy ending as you get in politics, most days.

Shikkiah Jordan, M.S.W. – Board Chair

Shikkiah is a research associate for the School of Social Work at the University of Arkansas and former Deputy Director of Peace at Home Domestic Violence Shelter. Shikkiah was instrumental as a consultant during the Your Media (formerly CAT) RFP 10-14 proposal-writing process to become the City’s public access outsourced provider in 2011.

Roger Henry – Board Treasurer

Roger is a Computer Support Specialist for the University of Arkansas. Roger produces one of Fayetteville Public Access Television’s longest running series, One Whirled View, which has been telecast for 18 years.

Maribel Albarran – Board Member

Maribel works for Legal Aid of Arkansas and is a graduate of the Walter J. Lemke Department of Journalism at the University of Arkansas. Active in the community, she serves on the Scholarship Committee of Hispanic Women of Arkansas and is an active member of LULAC # 769 – Fayetteville Chapter.

Bruce Castleberry – Board Member

Bruce is Community Outreach Coordinator for Credit Counseling of Arkansas where his emphasis is on grant-writing and outreach. He is a graduate of the Walter J. Lemke Department of Journalism at the University of Arkansas and has a long working history in print media, including thirteen years working for The Morning News.

Todd Daniels – Board Member

Todd recently took a corporate position with Coca-Cola, Inc. after nine years as a business executive for Walmart/Sam’s Club, most recently serving as Category Financial Planner in the Grocery Division at Sam’s. Todd was also Walmart Team Leader for the American Heart Association and is glad to bring his non-profit service and experience in marketing, financial planning and business to Your Media.

Bertha Gutierrez – Board Member

Bertha works for Credit Counseling of Arkansas and is a graduate of the Walter J. Lemke Department of Journalism at the University of Arkansas. Bertha, a local artist, writer and photographer, serves as a mentor for the Lemke Journalism Project, which gives high school students of diverse backgrounds an opportunity to write and produce their own newspaper with help from journalism faculty and mentors.

Peggy James – Board Member

Peggy James is an instructor of television production at Fayetteville Public High School. Peggy is an award-winning teacher who oversees Bulldog Television which is cablecast as the Fayetteville Education station on Cox Channel 217.

Molly Jensen, Ph.D. – Board Member

Molly is a Clinical Assistant Professor in the Marketing Department of the Sam M. Walton College of Business at the University of Arkansas. Molly was instrumental in spearheading the CAT re-branding process which led to many exciting changes, including the new name, Your Media.

Dave Johnston – Board Member

Dave does production work for KNWA, the local NBC/FOX affiliate station. Dave has been an active independent producer and volunteer for Fayetteville Public Access Television for several years.

Dennis Kirkpatrick, M.A. – Board Member

Dennis is an Assistant Professor of Broadcast Journalism at the Walter J. Lemke Department of Journalism at the University of Arkansas. Dennis has over 20 years of experience in sports journalism including work for Fox Sports Network and CNN.

Isiah Reese, M.B.A. – Board Member

Isiah does marketing and strategic planning consulting for organizations both for profit and non-profit as the CEO of Speak 2 ME Communication LLC. Isiah was active in Fayetteville Public Access Television for over four years before joining the board.

Rose Sparrow – Board Member

Rose is a Resource Specialist at the Arkansas Workforce Center. Rose also volunteers as a youth mentor and is a committee member of the NWA Women’s Conference. She brings her skills in community-building and networking to her board service for Your Media.

Community Access Television celebrates 30 years' service to the people of Northwest Arkansas and showing a wonderful video of the history of what first was known as 'Open Channel'

Dear Friend of Public Access Television:

Public access television has been a part of Fayetteville’s history for 30 years, making us one of few cities that has supported free speech TV as long. In that time, three organizations have provided public access television services for the City.

It is with pride in that history that I invite you to celebrate with me and others like yourself who have supported this unique medium of self-expression through the days of Fayetteville Open Channel, Access 4 Fayetteville and Community Access Television.

On Thursday, Jan. 27, at 7 p.m., at the Cosmopolitan Hotel, CAT is hosting an event to:

* Premiere "The Open Channel: Public Access Television and the People Next Door," a film about public access TV in Fayetteville produced by Niketa Reed;

* Introduce CAT's new executive director, Anne Shelley, who will announce exciting changes in the organization, including a new name;

* Begin rebuilding the organization’s membership;

* And recognize some of those who have been instrumental in local public access TV history.

CAT will be undergoing substantial change in the next five years as it seeks creative ways to serve the community through media access. I hope you will join me in supporting this vibrant new chapter in CAT’s history.

At the event this month, we will be asking you to become a “friend” of CAT through membership in our friends organization. This membership requires no commitment of time from you, just your support.

I hope that you will join us at the event and that you will renew your support for public access media in Fayetteville. Don’t forget your checkbook – we’ll have a silent auction as well – and bring some cash for the cash bar if you wish.

Equipment and Facilities Needed: Studio, 2 Cameras, edit bays 5 and 6.

Participant Limit: 4 Students

Dates of Class:

•Saturday, Dec 4th, 10am - 2pm
•Wednesday, Dec 8th, 5pm - 9pm
•Saturday, Dec 18th, 10am - 2pm

Description of Class:
The Accelerated Producer Training Class is designed for individuals or groups that have a strong interest learning multiple aspects of video production at the convenience of an accelerated rate.
This class incorporates the information and training that students receive in the Orientation, Field Production, and Basic Final Cut Pro editing classes.

During this class participants will:
• Learn about Community Access Television and the services it provides the community for the Fayetteville Public Access Television utilizing the City of Fayetteville Television
Center.
• Receive hands on training with field cameras and shot composition instruction.
• Receive hands on instruction on how to do basic editing using Final Cut Pro.
• Produce a short “public access producer’ promo for cablecast on Fayetteville Public Access Television.

Upon completion of the Accelerated Producer Training Class students will be equipped with the necessary training and certification to:
• Begin producing their own programs using City of Fayetteville equipment and facilities.
• Take advantage of ongoing technical support from Community Access Television staff.
• Take the “production refresher” courses that Community Access Television will provide monthly.

Request for proposals to manage Fayetteville public-access station for the coming 5 years issued for second time by Fayetteville city purchasing agent

Here is the new RFP with a deadline of 2 p.m. local time. The previous RFP brought in only one proposal and it was turned in one minute after the deadline. The purchasing office uses an "atomic-clock setting," which is about 7 minutes earlier than time one sees on CNN or Weather Channel or on your alarm clock or wrist watch. My computer provides "atomic-clock" time, which is supposedly more accurate for a given point on earth.

Ask Art Hobson to explain the process of determining atomic time. Only a physics professor is likely to explain it easily. And Art is a physicist who has been explaining his science to undergraduates for decades.

CAT board's proposal for a 5-year renewal of its management of Fayetteville's cable-access television station rejected because it was turned in one minute late

The City has rejected the proposal turned in by Community Access Television due to the proposal being submitted after the deadline. The City will issue a revised RFP for a provider for public access television services in the near future. Hopefully we will be able to re-issue the RFP this week or next week. I apologize for my delayed response.

In a phone call Wednesday morning, Ms. Foren confirmed her email to Mr. Bemis. She said that her office clock is get on the atomic clock system.

Interestingly, my home computer seems to show "atomic clock time" while television broadcasts through Cox Cable appear to use a system about 6 to 9 minutes later.
Maybe the CAT representative who delivered the RFP to the city purchasing office was walking over on television time.

SUBJECT: Coverage of meetings by The Fayetteville Government Channel

As a member of a City of Fayetteville Board, Commission or Committee, we appreciate tremendously the time, effort, and commitment you provide for the City of Fayetteville. It is citizens like you that help make our City as great as it is, and we thank you for your service. It is also service like yours that has helped make Fayetteville a state-recognized Volunteer Community of the Year. Thank you!

As you are probably aware, The City of Fayetteville operates The Fayetteville Government Channel, which provides television coverage of the meetings of City of Fayetteville Boards, Commissions and Committees for the citizens of Fayetteville.

While not every meeting receives coverage, most likely there will be a time when you will be in a meeting that is being covered by The Fayetteville Government Channel. I wanted to provide you with a few pointers and some information that can make your participation in these filmed meetings better for both those attending the meetings in person and those viewing at home. The ability for audiences in the meeting room, watching on TV, or viewing the meeting on the City’s website www.accessfayetteville.org to hear and see all that is taking place in the meeting is of prime importance to The City of Fayetteville and a major part of the initiatives of assuring open government and an informed citizenry. Also, your ideas are important, and we want to do everything possible to assure that your ideas are effectively heard by the audiences. Below are a few broad recommendations that will assist in these goals:

Be aware of your audience. Remember there are people there in the room, and there are people watching on television. When you talk, speak loudly enough that the people in the room can hear you clearly.
Some rooms have microphones on the tables. If there are microphones on the tables, please use one. If you do not see microphones on the tables, they are mounted somewhere else. Just speak in a way that everyone in the room can hear you clearly and the television audience can hear your comments as well.
When using a microphone, place it about a foot away and pointed at you, and talk in a normal tone of voice. If it is too close to your mouth, your voice will sound overly loud and distorted. If it is too far away, your voice may not be heard at all.
You may be on camera, whether you are speaking or not. It is not our intention to make you uncomfortable, but to make you aware. The audience in the room may be paying attention to the person speaking, but the camera may be on a wider shot and see you as well.
If a meeting is not called to order by the Chair within 15 minutes of its scheduled start time, the Fayetteville Government Channel staff may leave and not provide coverage for the meeting. This is to help minimize costs associated with having city staff waiting to film a meeting that will not take place for reasons such as lack of a quorum.
The Fayetteville Government Channel may not cover meetings in which no business is conducted.

The camera is in the meeting room in the role of an observer, so please avoid addressing the camera directly when speaking in a meeting. You are encouraged to engage in your meeting in the same way you would if the camera was not present. Fayetteville Government Channel coverage of meetings is direct, non-editorial programming regarding the operations and deliberations of the City government, not a mechanism for building support for a particular policy, program, or issue. If you would like to present government-related information to the television audience directly, the Fayetteville Government Channel can assist you in producing an informational program that can be telecast on the Channel.

Telecommunications Board Meeting Minutes

December 17, 2003

Room 219 City Administration Building

Call to Order and Roll Call. The meeting was called to order at approximately 5:35 p.m. Board members present were Susan Cromwell, Craig Brown, Steve Smith, John Lofton and Gary Cochran. Cox Communications Director Of Public And Government Affairs James Anderson, City of Fayetteville Chief Administrative Officer Hugh Earnest, Cable Administrator Marvin Hilton and CAT Manager Sky Blaylock were also present.

Approval of the minutes from November 19, 2003. Brown noted a word correction in the minutes and they were approved.

Adoption Of Agenda. Approved as submitted.

Cox Update

Telephone Survey.

Anderson reported that criteria have not been determined for the questions on the Customer Satisfaction Telephone Survey but expected they would be during the first quarter in 2004. He added that Cox is still looking at whether a survey is needed.

Cromwell said it is.

Smith volunteered to work on TCB questions and asked Anderson for Cox’ questions to avoid duplication.

Cochran asked the purpose of the survey and Cromwell said it is to determine if Cox is serving the community’s interest and if the City’s relationship with Cox is one we want to be ongoing.

Cochran asked if Cox has copies of past surveys and Anderson said he does not.

Rate Changes.

Anderson explained “MPR’” as “maximum permitted rate” and “OSR” as “operator selected rate” for Limited Basic Service. He said the current MPR is $18.18 and OSR is $15.85. In February 2004 the MPR will be $15.73 and the OSR will be $15.25 but ESPN 2 will be moved to Expanded Basic Service. The reduced cost to Cox will be passed down to the customer. When asked, Anderson said the cost of Expanded Basic will be released at a later date and customers will be notified by direct mail.

Cromwell then asked Anderson to explain the business issues and concerns of Cox.

Anderson spoke of Cox being like a local store that buys product at a wholesale rate and sells it at a retail rate, adding that they have limited shelf space and as wholesale prices increase the price of their product must also.

Smith asked if the upgrade is complete in Fayetteville to which Anderson said it was but now Cox is removing the old system.

When asked by Smith about complaints of poor reception, Anderson said Cox should be notified.

Smith noted a weak signal for FGC and CAT to which Hilton said the line from City Hall to the PEG Center is still coaxial cable, not fiber and that may be permitting the interference.

Anderson said coaxial cable is broadband cable, is still used and if not a bad piece of cable can still perform. He added that it was possibly the production equipment at the PEG Center and that Cox would look into the problem.

Smith then asked about a customer’s complaint of having to subscribe to all the audio channels in order to get a certain level of service and Anderson said he would find out.

Smith next asked Anderson if someone can subscribe to Cox internet service without subscribing to their cable service to which Anderson said it was a business decision that internet subscribers must also subscribe to at least limited basic cable service.

CAT Contract

Cromwell said Marvin Hilton, Sky Blaylock and George Weiss had cleaned up the existing contract. Along with the fact that CAT has performed and delivered the reports they agreed to, she entertained a motion that the TCB recommend to the City Administration to renew the contract with CAT.

Brown made said motion and with a second by Lofton it passed.

Update On Cox Audit By City.

Hugh Earnest addressed the board apologizing for a miscommunication between Cox and the City Auditor which has now been resolved. He added that the audit will be completed in January and submitted to the TCB for review and comment.

Cromwell asked the purpose of the audit given the confusion at November’s meeting and Earnest said it was to test the billing process to discover if the City is receiving the revenues it is due.

Smith said that with the increase in franchise fees to the City he thought the PEG channels should

receive more funds.

Earnest responded that a budget request to the City Council may be in order based on plans for a regional television system.

Cromwell mentioned that the TCB had “missed the boat” on the budgeting process this year and doesn’t want that to happen again.

Earnest suggested a workshop to explain the budgeting process.

Technology And Telecommunications Infrastructure Task Force

Cromwell said Councilman Don Marr has agreed to sponsor a resolution at the January 20, 2004 City Council to charge the task force.

Smith asked how task force members will be selected.

Earnest said that had not yet been decided and asked for suggestions.

Subcommittee Reports.

Education Channel Contract. Consisting of Cromwell and Young. There was no report as David Young was not present.

Website Policy. Consisting of Brown, Smith and Cromwell.

Not yet ready for discussion.

Government Channel Policy. Consisting of Lofton working with Hilton.

Lofton read the nine policy changes previously distributed to the TCB.

“1. Add a reference to the enabling legislation.

2. Add to the mission statement.

3. Add appeal to TCB to remove a program or meeting from a standing agreement to have it televised on a regular basis. This applies to meetings that were requested by an authorized requester who has since left the position that gave the authority to request.

4. Add any three citizens and committee chair to the categories of authorized requesters for televising meetings.

5. Clarify the term ‘other government units.’

6. Add any five citizens to the categories of authorized requesters for issue forums.

7. Add note about how citizens can access videos at the PEG Center.

8. Add a note about web casting.

9. Add a note about performance reporting.”

Smith moved to adopt the new government channel policy and with a second from Brown it passed.

Citizen Jim Bemis phoned in at this point with concerns regarding two issues he said he would address in depth when he attends the next meeting. The issues were;

A problem he sees with differing cable casting policies

How the TCB deals with complaints brought to its attention

Report from the Cable Administrator, Marvin Hilton.

Hilton said the TCB Roundtable discussion, set for January 30 at noon, has room for one more participant as eight seats have been filled. He added that NBC anchorman Don Elkins has agreed to be moderator. He also asked that the TCB vote to have this roundtable as Jim Bemis pointed out that if the TCB does not request it then it is the Cable Administrator’s roundtable.

Smith so moved and the second was not identified. It passed.

Hilton then inquired about the need for “a central point of reception” as he is not sure where all the documents regarding the TCB reside.

Cromwell said she thought they could all be found on the list-serve and Smith suggested they all be downloaded to a CD-ROM.

Lastly, Hilton reported problems cable casting live from the Fayetteville School Board and Washington County Courthouse. He added that he’d talked with James Anderson and was told it would be looked into.

Additional Board Members Comments. Smith announced that between now and the next budgeting process he plans to speak out for a dedicated percentage of the franchise fee for the access channels and that he is only speaking for himself and not the TCB.

The next meeting will be Thursday, January 8, 2004 in City Hall room 326 at 5:30 p.m. and will focus on the Infrastructure Task Force.

Adjournment. The meeting was adjourned at approximately 7:05 p.m.

Executive Director Position

Community Access Television is looking for an energetic, responsible and creative person to serve as Executive Director. CAT’s mission is to make available a medium of communication that provides freedom of expression and community awareness for all local citizens. The center offers training in video production, audio production, basic computer use (keyboarding, word processing), advanced computer use (graphics, animation, GIS), and Internet training.
A candidate for Executive Director must honor the First Amendment rights of community members who wish to use the public access station.
The CAT is a non-profit organization partially funded by the City of Fayetteville to provide community access media to the people of our community. At this stage I don't expect any self-realization from former CAT President Dedra Leaf. The spin she gives is predictable.
But as one of the people who demanded that "pound of flesh" (as well as being a person who was falsely accused of issuing "death threats"), I think there are a few items that should not go by the wayside: While she and hers have done a lot to maintain that VIPA was simply carrying out a grudge at the behest of the former manager, it doesn't change the fact that Dedra Leaf's CAT Board dragged their heels on FOIA requests, tried to rewrite policy behind closed doors and keep it away from the public eye, violated content neutrality policies, Leaf herself absconded with employees' private files and information, posted the former manager's evaluation online where anyone could see it and then openly discussed what some employees at CAT are being paid in a televised public meeting.
VIPA were adding addendums to our complaint against Leaf mere days out to the meeting...it was like there was a pathological need on her part to cause as much damage as she could on her way out the door.
VIPA support the new CAT Board under David Orr and believe that they will proceed with a good deal more fairness and intelligence and that they'll help rebuild faith in the organization.

Richard S. Drake Excellent. It showed a sad lack of self-awareness on the part of Dedra Leaf that she could come out with this nonsense. And, of course, it was another example of the "press release journalism" practiced at the NWA Times. Someone in authority says something - no matter how untrue or outrageous - and the NWA Times accapts it as gospel. All along, they were in possession of the true facts of the situation. I have NEVER seen such sloppy reporting on access issues in Fayetteville.

FAYETTEVILLE — When the Fayetteville Community Access Television Board met in a retreat Saturday that was not open to the public, it did not violate Arkansas’ open meetings law, legal experts say.
“Independent contractors of the city (like CAT) are not statutorily required to comply with the Freedom of Information Act in relation to the ‘public meetings’ requirement,” wrote Kit Williams, Fayetteville city attorney, in a memo to Lindsley Smith, Fayetteville communication director.
Fayetteville Community Access Television has a $93,000 a year contract with the city to offer local access television. This amounts to the bulk of CAT’s budget, according to a review of the station’s financial documents, which are public records in compliance with FOIA.
Holding a closed-door retreat on the final day of National Sunshine Week did not go unnoticed. Sunshine Week is organized by journalists and others to shine light on Freedom of Information Act laws. Jim Bemis, a CAT producer, showed up at the Omni Center for Peace Justice and Ecology, the location of the retreat, camera in hand.
“What irony that the community’s public access channel is closed to public and media during Sunshine Week — which is intended to celebrate the Freedom of Information Act,” Bemis wrote in an e-mail Saturday.
,John E. Tull III, a Little Rock lawyer who serves as general counsel to the Arkansas Press Association, agreed with the city attorney’s opinion.
“I do not believe it (the retreat) violated FOIA, or that FOIA applied to the retreat,” Tull said Wednesday, via e-mail. “If all the board members were city employees or there were some other public connection my answer might be different. But the mere fact that most of its revenue is tied to the city, by itself, does not mean FOIA applies to all of its meetings in my opinion.”
A review of FOIA-related opinions by Arkansas Attorney General say private contractors doing business with government are subject to the Arkansas Freedom of Information Act.
“Private entities are subject to the FOIA only if (1) they are ‘wholly or partially supported by’ public funds, and (2) their activities are intertwined with government,” reads a Nov. 2008 opinion in regards to whether the private company contracted to provide busing services for the Little Rock School District are subject to Arkansas’s open records law. Williams, Fayetteville’s city attorney, has repeatedly affirmed that CAT documents are part of the public record.
CAT board president Debra Leaf said no business was discussed or conducted on the retreat.
“It is a chance for us to get to know each other as fellow board members in order for us to be able to work together as a board,” Leaf said. Board members Marietta Camiellieri, Rose Sparrow, Dave Johnston, David Orr and Roger Henry attended the retreat. Board members David Young and Bruce Perry had prior commitments, Leaf said.
Bemis videotaped the first two hours of the retreat.
He intends to make the recording available to CAT to have the full board decide if it (Bemis’ recording) will be shown on the Fayetteville public access station.
“It was completely innocuous,” said Bemis on the nature of the meeting he witnessed.

Thank you for your work in trying to ensure public information about the public's interest. I appreciate your diligence and your contributions to the CAT Policy committee. As I stated to Aubrey, you will be welcome to observe the Contract and Policy sessions of our orientation, but you will be asked to leave before the session on Board Obligations and Responsibilities. It isn't that I mean to be rude or exclude you or anyone but that information and discussion should be between the members of this board in order for us to build unity, something we desperately need at this time. I have excluded cameras because, as an educator you must know, hands go down when the camera goes on. I want everyone on the board to feel free to ask whatever questions they may have without worrying about how ridiculous that question may make them sound. I want interaction and that won't happen with the camera on. No discussion or debate about policy will be taking place; it will be strictly informational.
As far as the Policy committee records go, there are digital as well as print copies from as far back as '07, when I began chairing that committee. We're still working on a way to get those old records archived for the public.
Please remember, half of our members have been on this board for less than two months. We are, essentially, trying to build cooperation and unity from the ground level. Please respect that.
If you wish to file a formal complaint with the CAT Board you are welcome to do so according to our policies.

I hope everyone has a chance to watch the FGC production of the Telecommunications Board meeting last night. It covered a range of topics, all of which would be useful at the CAT Board's retreat last night, and it will be archived for future use in orienting both the Telecom Board members and CAT Board Members, as well as the CAT producers and public.

I regret that the CAT Board was not represented at that meeting, and that President Leaf has to exclude video recording and has declared that the Retreat is not open to the public.

Therefore, I ask that this email note be considered as a formal complaint regarding President Leaf's decision to declare that the meeting is not open to the public and she has chosen not to have it videotaped. My understanding of current policy is that this note should suffice for purposes of making a complaint.

I also have read Lindsley's note of today that relays the City Attorney's opinion regarding the the FOIA criteria that he feels would apply to the CAT Board's retreat. However, I respectfully disagree with Mr. Williams, although I believe I understand his reasoning.

As a "Community Board" member of the CAT Board Policy Committee, I understand that it is my job to inform the community of Board policy deliberations and related discussion by the Board, such as reflected in the agenda for the Retreat to be held on Saturday. Therefore, I will attend the CAT Board Retreat tomorrow, as I indicated at the Telecom Board meeting last night.

I will be recording the proceedings as a "Community Member" of the CAT Board's Policy. Members of the Policy Committee will recall that I have videotaped the Policy Committee meetings over the past three months, as a means of documenting the
actions of the Committee. We have had at least two chairs of the Committee since the first of the year, and the minutes of the meetings have been difficult to recover, either in written form or in digital recordings. Thus, my purpose for documenting the
Retreat will be for my own use as a CAT Committee member and for use by other Board members, if they choose (as indicated in an earlier email.)

I also will produce a video for use on CAT and for later archiving and, based on Mr. William's comments as relayed by Lindsley, I will submit that recording for televising on CAT, using the regular producers request form. I anticipate that the full CAT Board can then consider the disposition of my request, if necessary. Similarly, if there is a need to consider my request as a "test case" regarding the legality of televising the meeting, I will be happy fill that role. I would urge the CAT Board to ask for an opinion on from the Arkansas Attorney General's office. I agree that there may be a need to test on a case-by-case basis.

I wish a member of our board had been available to attend last night's meeting, a practice we have been trying to make over the last several months, but we have been very busy with our duties involving the search for a new manager and the restructuring of positions we feel necessary to make at this time too alleviate the current stress on our staff. Last night was another of many meeting we have been holding during the last month. In all that time, during all of those meetings, I have been trying to integrate and educate four new members to our board. Some of those members have at least some board experience, but every board is different as you probably know.
The information our members will be receiving tomorrow is the same information found on our website, but it will be presented to the members in a comfortable, noninvasive environment so that they may for five hours come together as a group without public scrutiny. This orientation is about more than imparting information. It is about bringing individuals together, teaching them the value of each other and getting them to work as a group. I feel that is more in the public's interest than recording the event for later review.
I have sent you a program for tomorrow's retreat. We will be preparing new board books with all of the information we will be using tomorrow and I plan to have one in the office at all times for public viewing. I think it would be a very good idea for the Policy committee to produce a series of round-table discussion of those documents we will be discussing (contract, bylaws, policies) to provide a more detailed public discussion of the same. Perhaps that is a project they can work on when their current business is less pressing. I'll suggest that to them at the next board meeting.
Although I value your advise and have carefully considered your suggestion, I am the one who has to do what is in the best interest of creating a strong, unified board out of one that has been through an awful lot in the past few months, and I do not feel it is in the best interest of Community Access Television to record this orientation.

Dedra, the Telecom Board voted last night for me to contact you about your retreat plan.
Holding a retreat can be an important thing to do.
I have watched Telecom Board and City Council retreats on Government Channel many times in the past decade. And I have also watched retreats held by various other boards and committees on television. I have learned from every one!

The Telecom Board told me to ask respectfully that you arrange to record your retreat and show it on CAT soon.
As one member of the audience asked during the Telecom Board discussion Thursday night, "Why wouldn't they want it recorded?"

I personally would consider spending the time and effort that goes into this process wasted if it is not recorded and broadcast. Who will remember every detail, every major idea discussed, every suggestion, otherwise. How much more value will the effort have if it is saved for later review?

Please consider the Telecom Board's suggestion.

Not Even New Administrator Can Fix CAT Problems

FAYETTEVILLE — Two weeks after an interim administrator was named at Community Access Television, the transition has not been smooth as the Fayetteville Video Independent Producers’ Association continues to question actions by the CAT Board of Directors.

The independent producers wondered why CAT Board President Dedra Leaf removed files from the office of former CAT manager Kathryn “Sky” Blaylock.

“I took the tax records and personnel files home on Feb. 18, returned the tax records on Feb. 23, but have retained the personnel records until the personnel committee can review the employee evaluations we requested from Sky back in December,” Leaf said.

Leaf added her aim is to better organize the files and familiarize herself with operational aspects of the local access television station.

They are still accessible through the Freedom of Information Act, Leaf pointed out.

“Whether the files are in my possession or in the office they are, of course, subject to FOI,” Leaf said. “We’re working on getting all monthly reports and minutes up on the Web site so our business is a little more accessible to the public, but if there is anything anyone wants to know it is available to them, as long as it is a public document.”

“I can think of no reason why those files should EVER leave the building,” wrote Sheree Burnett in an e-mail to CAT board members and producers. “Whether they go home with the station manager or the president of the board ... They shouldn’t be going home with anyone. EVER!

“This is blatant micromanagement,” she continued.

Leaf contends though the bylaws do not speak directly to her authority to retrieve files, she has informed the board of her decisions, and has been in regular contact with Mark Warren, who is serving as interim CAT administrator.

“If they have concerns over my actions they have not expressed them to me, but I’m sure this will be discussed at the next board meeting,” Leaf said.

Warren, who formerly served as production coordinator for CAT, reports it’s been mostly business as usual at the local access TV station.

“So far, everything has been surprisingly, fairly easy,” Warren told Leaf earlier this week.

For Leaf and several other members of the CAT board, the last several months have been anything but easy.

C.F. Roberts, who heads up the Fayetteville Video Independent Producers’ Association, says the association wants Leaf removed as a member of the CAT board.

“Dedra, at this point, is referring to us as the ‘Accusation of the Month Club,’ but we never dreamed she’d give us as compelling a reason as tampering with personnel files,” Roberts said.

Leaf says she has tried to meet with the handful of producers who have expressed discontent with the board’s decisions.

“They say they want to be heard, yet we have asked them to speak to the board and they refuse,” Leaf said, identifying Roberts, Burnett and Richard Drake. “They throw accusations around the Web, but are not interested in engaging in civil discourse when the offer is made. I’m still hoping for a positive outcome, but I’m beginning to think the only thing that will satisfy them is my resignation.”

In the next few weeks the CAT board will hold a retreat to orient new members to their responsibilities and the rules that govern CAT. Leaf said she hopes more ideas will come forward regarding how to repair the relationship with the association.

In the meantime, the board has formed yet a new subcommittee — Administrative Transition Advisement — to assist Warren with his new role as interim administrator. Jim Goodlander, a former CAT manager has volunteered time to serve as a member from the public. Leaf and fellow board members Roger Henry and David Orr also serve on the subcommittee.

Leaf assured Warren he should not hesitate to consult the subcommittee.

“Even if you think it’s a piddly thing, send it to me, and if I think it’s big enough, I’ll send it to the board,” Leaf told Warren.

Since Fayetteville maintains a $93,000 a year contract with CAT for local access TV to residents, officials say they’ve been watching the conflicts closely, but the problems have not indicated a breach in CAT’s ability to carry out its responsibilities in the contract.

“We want to make sure that the law is followed and the FOI is followed,” said Lindsley Smith, communication director for Fayetteville, explaining what she looks for when either internal or external problems at CAT surface.

“I always provide answers and then I guess, closely monitor what’s going on,” Smith said.

We know of no better example of the old political adage of “the smaller the pie, the bigger the fight” than the recent fuss out of Community Access Television in Fayetteville.

The question we take up today is not whether or how the cable franchise fee-funded group can get past its personnel problems and run smoothly. No, our topic is whether the city should continue to give $93,000 a year to the venture.

We’re going to follow our own advice here and ignore the personality clashes that led to the resignation of the longtime CAT manager on Thursday. What reallymatters is whether cable subscribers can reliably turn on their TVs and see content of public interest. A close second is providing a resource and an outlet to people interested in producing video.

As long as those goals are met, we really don’t care who runs the show, what noises they make or how happy they are. Believe us: If everything had to wait until peace and harmony broke out, no newspaper would ever get published.

We’re encouraged by the selection of production coordinator Mark Warren for the post of interim manager. We understand the concerns of Dedra Leaf, the board president. “My only concern with you, Mark, is who’s going to do your job?”

Leaf asked during the meeting to choose an interim manager. However, some continuity is exactly what CAT needs right now. Promoting a staff member helps quell the allegation that the board wanted to micromanage the station.

The personnel committee intends to spend the next several weeks fleshing out what exactly it wants in a manager and reviewing resumes. We’re very encouraged by Leaf’s remark that the personnel committee needs to meet every week: “We have that much work to do.”

Yes, they do. If and when the public is not served, the city needs to find some other entity to run things or save $93,000 a year - even if things settle down and everything becomes peachy and blissful within the station itself.

The recent hyperbole needs to stop. One producer recently went so far as to tell a city board things would not run smoothly if the manager resigned. One board member alleges to have been the subject of personal threats and harassment.

Drop it and behave, folks. Pick a new manager, get your three new board members up to speed and put this squabbling behind you - for as long as you can, at least.

Perhaps the best summary of the whole situation comes from Katherine Shurlds, a journalism instructor at the University of Arkansas who was once a station manager at CAT: “I really want people to support it.

Even though it is a pain in the ass.”

Good luck with that. It should be entertaining.

Board Looks To Staff For Interim Manager

FAYETTEVILLE — The Fayetteville Community Access Television Board looked to its own staff when it selected the interim administrator for the local access television station.

Mark Warren, production coordinator, for the station, will serve as interim head of the organization while the board reviews resumes and selects the next manager.

Kathryn “Sky” Blaylock, who served as manager for the last several years, recently stepped down. Her last day at the station was Tuesday. Blaylock’s last day was originally set as Thursday, but she will take her two final days as sick days, Warren told the personnel committee Tuesday evening.

Having Warren as interim manager was not the choice of Dedra Leaf, the board president. Leaf was concerned about Warren being able to complete his production duties and also wear the hat of administrator.

“My only concern with you Mark, is who’s going to do your job,” Leaf offered.

“Stacking on a few extra duties for me, even if it’s interim, is not going to kill me,” Warren told the board.

Leaf’s choice was Avyi Shoup as interim manager. Shoup, a former station employee, is familiar with the organization, and recently worked under Blaylock as a contract worker. Also being considered was Erin Condiff.

Having an in-house staff member serve as interim manager seemed to be what the rest of the board wanted.

“It would be a smoother transition by having him here already,” said Rose Sparrow, board member, supporting the idea to name Warren as interim manager.

“I think Mark is someone we should seriously think about,” said Bruce Perry, another board member.

For his part, Warren said he plans to apply for the station manager job.

Community Television Manager May Step Down

FAYETTEVILLE — Kathryn “Sky” Blaylock has threatened to resign her post as director of Fayetteville Community Action Television unless the group’s board of directors retracts what Blaylock calls “defamatory statements” from her employee evaluation.

Blaylock has held the post for seven years.

“Due to my personal, moral and integrity standards, I cannot work for unethical people or organizations,” wrote Blaylock in the opening statement of the letter of resignation she filed with the CAT personnel committee last Tuesday.

The personnel committee met Jan. 19 to review Blaylock’s “job performance standards,” which were given to her in December. At the time, the CAT board made a series of recommendations to Blaylock regarding the management of the CAT staff and the overall operation of the station. Those recommendations have not been made public since the job performance standards are part of Blaylock’s personnel file, which is not a public document.

Board president Dedra Leaf said the board intends to act on the resignation at its February meeting.

It’s not entirely clear what controversy exists between the CAT staff and the board.

“How my staff uses their time; maintains city equipment and meet deadlines is my responsibility as their employer,” Blaylock wrote in her letter. “Any criticism of my staff is welcome and seriously considered, but needs to be directed to me for action to prevent invasion of privacy.

“I implore the Board to reconsider their draconian demands of mine and my staff’s time and allow us to be unfettered and unbound in continuing to provide the level of service this community has become so accustomed to and rightly deserves, at the same level of oversight we had received until now,” she continued.

Internal turbulence at CAT has been ongoing. Longtime CAT board member and president Colleen Pancake resigned Dec. 8, 2009, amid disagreements between her and Blaylock.

The city of Fayetteville has a $93,000 a year contract with Fayetteville Community Access Television to provide public access television services for Fayetteville residents. The money is funded through cable television franchise fees.

December 10, 2009 CAT Board Meeting

The December 10, 2009 meeting of the Community Access Television
(C.A.T.) Board of Directors was held in the studio of the PEG center
at 101 W. Rock St. in Fayetteville, Arkansas. Dedra Leaf,
Vice-President of the Board, called the meeting to order shortly after
6:00 PM.

Board Members Present
Dedra Leaf, Vice-President; Roger Henry, Treasurer; Bernard Sulliban,
Secretary; Bruce Perry; Mariette Camillieri. Also present was Sky
Blaylock, C.A.T. Manager and Sheree lliariBurnett, Certified CAT
Producer and volunteer.

Vice-President Leaf began the meeting by announcing that President
Pancake had resigned. She then asked Bernard Sulliban to read the
letter of resignation for the record (see attached). Vice-President
Leaf then thanked Formal President Pancake for her many years of
service to the organization.
Vice-President Leaf then noted that the Board needed to address the
issue of the bylaw stating the minimum number of board members, as the
current number of members was now five. She asked if anyone wished to
make a motion to amend the bylaw. Ms. Blaylock noted in a point of
order that the Board should read the last amendment of the bylaws,
which states that changes proposals to amendments must be submitted in
writing to all board members at least 15 days in advance of the vote.
After the board members read the bylaw article Secretary Sulliban
apprised the board that long as the quorum number for 7 was reached,
which the number of 5 exceeded, the board could conduct business. He
advised that the issue would have to be addressed, but it would not
prevent the performance of business at that meeting. Leaf made the
suggestion that the copies of the suggested bylaw changes be sent out
to the board members in the next few days and the issue be addressed
at the next board meeting. The other members gave their assent. Leaf
said she would send the changes to the board members in the next few
days.
Vice-President Leaf then announced that there were no November minutes
to read at that time, but that she would have them for the next board
meeting.
Treasurer Henry then read the Treasurer’s report. The Board members
did not have copies of the report, so Treasurer Henry highlighted
items of interest for them. He announced that numbers for the month
were quite satisfactory. He stated that there were no untoward
expenses. He noted that producer fees were down, probably due to the
economy. He surmised that more people were producing videos with their
own equipment, requesting it to be aired on the CAT and thus affecting
the cost of the producer fees. He then announced that the Manager had
paid off the credit cards and there was no credit card debt as of the
December meeting. He noted that the cost of web-streaming was high,
but said that that cost would be reducing at some point. The Manager
noted that the web-streaming expenses for 2009 included installation
and that would not be part of the expense for the service for next
year. Henry then encouraged board members to print their own copies of
reports in order to save the CAT that expense. The .03 cents per copy
can add up to five dollars per meeting and that was one way to curb
expenses. He reported that the total operating expenses were
approaching 100% of the budget, but what is not noted in the report is
the last check from the city, which would reduce that number.
Advertising (for the Media Conference) and outreach expenses were high
than budgeted, but they had paid for the March Media Conference and
the October Spooktacular event at the Town Center, events that should
be considered an investment in the community that are coming back in
contract shoots.
Henry then commented that the previous night had been an exciting
event and asked when it would air. The Manager replied that the Rat
Pack portion of the taping would air on Saturday before they left
town. She added that they were performing at the Walton Arts Center.
She then told the board about “The Inger Show”, a show contracted by a
vice-principal from Rogers. Ms. Blaylock stated that two shows were
taped with elaborate sets and was probably the second biggest
production they had ever done, next to the Lion’s Club Auction. She
announced that Inger would be back and wants to open a series time
slot, but that would happen after five shows were ready for playback.
Henry then concluded the Treasure’s report.
Vice-President Leaf then asked if any of the members would mind if she
moved the Manager’s report to the position on the agenda above
Committee Reports. There were no abjections. Leaf then asked the
Manager if she was ready to give her report at that time. Ms. Blaylock
read her report, which recapped highlights of the year’s outreach
activities and noted the busy end-of-the-year production work the
staff was currently doing, due in large part to the success of the
outreach events in connecting the CAT to members of the community as
well as other organizations. Post production works were listed as “The
Grid Iron Show”, “The Amazing Race”, Goeff Olsner’s CD release party
and two music videos, a public meeting for the Fayetteville Parks
Department, two Indonesian International workshops, one with the Ford
Fellows, the Spooktacular and the underwriting spots for The Farmers’
Coop, Cajun Gypsy?, Greenhouse Grill, Adventure Subaru, and Arkansans
for Equal Access. Contract studio productions were listed as the
“Lion’s Club Auction of the Air”, “The Monthly Ministerial Alliance”,
“Diversity en Espanol” featuring Claudia Steele and “The Inger Show”.
She also noted that the outreach event had resulted in a number of new
trainees. The Manager stated that she expected those numbers to grow
in the coming year with the upcoming 30th Anniversary. She also
apprised the Board of a letter she had received from Delani Bartlett,
who had coordinated the Media event in March and is now teaching at
NWACC. The letter from Ms. Bartlett announced that NWACC would be
sponsoring events from April 5-9, 2010 to build awareness and bring
information to the community about the First Amendment and invited the
CAT to participate. She also mention Chris Carson Shane Houston as
people we might want to include in our 30th Anniversary. Leaf thanked
the manager for her report and noted that the outreach for 2009 had
been phenomenal.
Under Committee Reports, Camillieri said that the Outreach Committee
would set a day to meet in January.
Leaf announced she had passed the chair to Bernard Sulliban, who had
agreed to take it, and that at the last meeting they had discussed
changes that needed to be made to Policy to reflect the changes in the
current contract with the City of Fayetteville. She offered to get the
four pages of suggested changes to Sulliban. Sulliban set the next
Policy meeting for Tuesday, December 15 at 5:00 PM in the break room
of the PEG Center, at which time he and the committee would review the
changes as well as the change to the bylaw that had been mentioned
earlier.
Finance Committee set a meeting for January 5 at 5:00 P.M. in the
break room of the PEG Center to discuss the 2010 budget and make final
adjustments before presentation to the Board at the January meeting.
Leaf announced the Personnel Committee had a little more work to do on
the Manager’s evaluation in order to give it to the Manager at the
meeting. She stated that they would need to go into executive session
in order to conduct that business and asked if anyone wanted to make
that motion. Sulliban asked Leaf if there was other committee business
or other business that needed to be addressed at the meeting. Leaf
replied that there was the old business of the proposed joint meeting
with the Telecom Board, but that business could wait until January.
Sulliban made the motion to table the Old Business until next month
Camillieri seconded the motion and it carried unanimously. Sulliban
next made the motion to undertake the New Business and defer on the
Personnel Committee action in order to hear Public Comment before the
board retired to executive session. Perry seconded and the motion
carried.
Under New Business Sulliban stated that the Board needed to seat a new
president. He made a motion that the Board vote in Dedra Leaf
officially as the Cat Board President in light of the recent
resignation of former President Pancake. Leaf asked if there was a
second. Perry then asked Leaf if she wanted to be president. She
stated that it was not something she had chosen, but that she would do
the job. Perry further stated that he didn’t want Leaf to obliged to
take the job and wanted to offer her a choice. She stated that the
Board held elections in April and she would be willing to hold the
position until then. Camillieri then seconded the motion. Leaf was
unanimously accepted as President of the Board of Directors of
Community Access Television.
Sulliban brought up the need for a new vice-president, but suggested
the members might want to wait until a later time to address that
issue. Leaf and the other members agreed and Leaf said they could
address the issue at the next monthly meeting.
Perry then stated to the audience that that the Board had just lost
it’s president and was trying to regroup and figure out how to proceed
and asked for patience.
Leaf then called for Public Comments. Sheree Barnett, a producer and
volunteer, presented a petition to the board signed by 16 producers
stating:

“We, the undersigned producers of Community Access Television would
like to make the following statement:
We fully support Sky Blaylock and the entire staff of CAT. We feel
their job performance has been exemplary. We feel the current
complaints against the staff are unfounded. The staff has always been
fully available to assist us in our endeavors.”

Barnett stated that the petition was in response to the six hours the
Board spent in executive session during the personnel committee
meeting the previous Tuesday. She also stated that she felt the staff
was overworked and the Board should look into getting more producers
to volunteer or hire help for the staff.
Leaf asked if there were other comments. There were none. The Agenda
then moved to the Personnel Committee. Leaf stated that Personnel
issues were private business between an employee and the personnel
committee. She asked the public to respect that.
Perry made the motion to move to executive session. Camillieri
seconded the motion. The Board the adjourned to executive session to
complete the manager’s evaluation and to give it to her.
When the board returned Leaf announced that the personnel committee
had given the manager’s evaluation to Sky Blaylock. She asked if there
was any other business. Sulliban reminded her that the Personnel
Committee needed to set a date to meet with the manager to follow up
on the evaluation. The board agreed to meet on Tuesday, January 19 at
5:30 P.M. at the PEG Center in the break room.
Sulliban thanked the producers for coming out in support of the
station and staff, especially at this point in time.
Camillieri wished the public ‘happy holidays’.
Sulliban made a motion to adjourn the meeting. It was seconded by
Camillieri and agreed to by the members. The meeting was adjourned.

CAT board president responds to producer's complaint

Dear Ms. Burnett,

My only purpose in responding to your complaint was to let you know that the issues in your formal complaint would be addressed by the Board in the manner by which we have addressed other complaints addressed to the Board: it will be read to the Board and sent to committee for a recommendation to be acted upon by the Board at the next (February) meeting of the Board of Directors. I wanted you to know that we have been in the process of addressing some of those issues and the bylaws regarding our minimum number of members has been slated to be addressed at the January meeting since our board meeting in December. It will be one of our first orders of business.

For the record, the minimum number of members only affects the number of members need to achieve quorum. Right now we need four members to have a quorum. Any more than one person absent from a board meeting prevents us from conducting business.

Since you were dissatisfied with my earlier choice to not put your complaint on the agenda for this month, but refer it during the committee reports, I have place your complain at the top of the agenda for tomorrow night. The rest of your concerns will be addressed at that time.
